Kratom Overdose Lawsuits

The opioid epidemic in the United States resulted in devasting consequences to those with chronic pain, and many have made efforts to switch to natural painkillers, such as Kratom. Kratom (Mitragynine speciosa) is a plant that produces chemicals producing similar effects on the body as opioids. Historically, southeast Asian farmers would chew the leaves of the Kratom plant to increase productivity and reduce fatigue. In 1943, the government of Thailand actually made it illegal to plant Kratom trees and classified it as a narcotic. There is no legitimate use for Kratom in the United States, and it has been linked to numerous overdoses, some leading to death.

Numerous lawsuits are being filed against the manufacturers and sellers of Kratom products. Millions of dollars have already been awarded to those who have lost family members due to Kratom (Mitragynine) intoxication, including:

$2.5 million—Cowlitz County, Washington
Wrongful death of a 39-year-old man with chronic back pain

$11 million—Palm Beach County, Florida
Wrongful death of a 39-year-old mother of four

Potential Claim—New York City, New York
Death of a 27-year-old schoolteacher caused by fatal seizure from overdose

Pain is not the only reason that people use Kratom. They have found that it appears to relieve symptoms of stress, anxiety, depression, and posttraumatic stress. Kratom is easy to get. It can be purchased online, in vape and tobacco shops, liquor stores, gas stations, and bars and restaurants and can be taken in many forms. There are teas and energy drinks containing Kratom, in addition to capsules containing powdered Kratom. Many bars are advertising Kratom as an alternative to alcohol and are using it in mocktails to produce a buzz without being drunk.

The Food and Drug Administration (FDA) estimates that over 1.5 million people in the United States used Kratom in 2021 alone. Despite the known dangers of this supplement, the FDA has no control over its regulation, but has warned against its use and has classified it as an opioid. The Drug Enforcement Agency (DEA) has classified Kratom as a “Drug and Chemical of Concern”. The DEA has also noted that 15 deaths occurred between 2014-2016 due to Kratom use. Kratom overdose can lead to seizures, psychosis, and death.

Manufacturers of Kratom have advertised their products as safe and effective, despite numerous reports of injury and death from overdose. They have intentionally ignored any warnings from the FDA and DEA and have failed to acknowledge the dangers of their products. Although the FDA and DEA have not officially classified Kratom as a dangerous drug, the warnings of the danger of using Kratom have been in place for many years. Kratom manufacturers take no responsibility for their product’s role in these deaths and continues to market Kratom as safe and effective.

There is a major gray area in bringing claims against Kratom manufacturers. Claimants must be able to identify a Mitragynine overdose and the manufacturer of Kratom that individual purchased from. It is best to work closely with your doctors and an experienced Kratom Overdose Attorney to determine all of the facts.

Below are several known manufacturers and distributors of Kratom. This is a short list. Due to lack of regulation, there are an unknown number of manufacturers and sellers of Kratom.
