As of March 2024, numerous lawsuits have been filed against the manufacturers of Proactiv, Clearasil, Clinique, and others claiming that the companies were aware of the risk in exposing its consumers to a dangerous cancer-causing chemical called Benzene. Due to their failure to warn their customers and doctors of the risks involved in using their products, manufacturers including Alchemee and Taro Pharmaceutical are facing a potential for thousands of lawsuits. These claims are very new and anyone who has ever used Proactiv, Clearasil, and Clinique acne products should call Neumann Law Group today.

A study performed by Valisure, an independent quality assurance organization found that the main component in Proactiv, Clearasil, and Clinique called Benzoyl Peroxide (“BPO”) will deteriorate into a chemical called Benzene. Valisure tested around 100 BPO products found that the levels of Benzene were over 800 times the maximum amount permitted in any medication.

Benzene is classified by the World Health Organization and the International Agency for Research on Cancer as a cancer causing chemical (carcinogen) to humans and can be found in things such as cigarette smoke and heavy cleaning products. Benzene can enter the body in many ways including through the air, skin, eyes, and mouth. It interferes with the human bodies’ ability to produce red blood cells and also will interfere with white blood cell levels.

In 2011, The Food and Drug Administration’s (“FDA”) published guidance for Acne Drug companies that use BPO and implemented new labeling requirements for acne products containing Benzoyl Peroxide. The FDA is of the opinion that Benzene must not be used to make pharmaceutical products; however, an exception was made in 2010 that should a product require Benzene, the levels were not to exceed 2 parts per million. The Valisure study found that Proactiv’s 2.5% BPO Cream contained 1700 parts per million. The results of their study were presented to the FDA as a call for help. Further, literature dating back to the 1930s identified the degradation of Benzoyl Peroxide to Benzene. The manufacturers of Proactiv, Clearasil, Clinique had plenty of notice.

Despite the decades old warnings, to date Proactiv, Clearasil, and Clinique have failed to modify their product or provide proper warnings to consumers and doctors that they were using a cancer-causing product. They continue to advertise their acne products, sell them, and allow doctors to continue using it as a prescription. They have blatantly ignored the FDA’s warnings. Claiming that a product is safe without providing proof of safety testing is unacceptable. The manufacturers of Proactiv, Clearasil, and Clinique should be held liable for any injury or death from encouraging people to consume a cancer causing chemical.

Benzene has been linked to the development of cancers such as acute myelogenous leukemia (AML), myelodysplastic syndrome (MDS), and other serious health effects.

Dermatologists have also been affected by this development as these products were advertised as safe and were often prescribed to their patients for acne. Fortunately, dermatology doctors and experts at Yale University have taken interest in assisting with research and regulation.
